{"id":2923,"date":"2026-08-16T19:23:43","date_gmt":"2026-08-16T19:23:43","guid":{"rendered":"https:\/\/watchthenews.store\/?p=2923"},"modified":"2026-08-16T19:23:43","modified_gmt":"2026-08-16T19:23:43","slug":"brown-jackson-declines-trump-admin-request-over-mail-in-ballot-order","status":"publish","type":"post","link":"https:\/\/watchthenews.store\/?p=2923","title":{"rendered":"Brown Jackson Declines Trump Admin Request Over Mail-In Ballot Order"},"content":{"rendered":"<p class=\"wp-block-paragraph\">Brown Jackson Declines Trump Admin Request Over Mail-In Ballot Order<\/p>\n<div class=\"code-block code-block-2\">\n<div data-type=\"_mgwidget\" data-widget-id=\"1982543\"><\/div>\n<\/div>\n<p class=\"wp-block-paragraph\"><i>President Trump\u2019s ongoing efforts to make elections more secure ahead of the fall midterms hit another snag late Monday.<\/i><\/p>\n<p class=\"wp-block-paragraph\"><strong>Not only is the GOP-controlled Congress doing little to help the president,<\/strong><\/p>\n<p class=\"wp-block-paragraph\">but now Joe Biden\u2019s DEI justice on the U.S. Supreme Court has thrown up her own roadblock.<\/p>\n<p class=\"wp-block-paragraph\">The Trump administration asked the U.S. Supreme Court on Monday to allow full enforcement of Trump\u2019s executive order imposing additional restrictions on mail-in voting.<\/p>\n<p class=\"wp-block-paragraph\">In the filing, U.S. Solicitor General D. John Sauer argued that a federal judge\u2019s order blocking portions of the executive order in 23 states and the District of Columbia was \u201cextraordinary\u201d and said it \u201cflouts settled\u201d legal principles governing when federal courts may intervene in disputes.<\/p>\n<p class=\"wp-block-paragraph\">Sauer also asked the Supreme Court to issue an immediate administrative stay, which would temporarily suspend the lower court\u2019s ruling while the justices consider the administration\u2019s request.<\/p>\n<p class=\"wp-block-paragraph\">But Justice Ketanji Brown Jackson later Monday declined the administration\u2019s request without issuing a formal ruling, instead ordering the plaintiffs to respond to the government\u2019s emergency application within seven days.<\/p>\n<p class=\"wp-block-paragraph\">\u201cThe Trump administration asked the Supreme Court to restore key parts of President Trump\u2019s election integrity executive order, including provisions directing USPS to change federal mail-ballot procedures, arguing lower courts blocked the policy before any final agency action,\u201d SCOTUSBlog noted on X.<\/p>\n<p class=\"wp-block-paragraph\">Trump signed the executive order at the center of the case, titled \u201cEnsuring Citizenship Verification and Integrity in Federal Elections,\u201d on March 31.<\/p>\n<p class=\"wp-block-paragraph\">Among its provisions, the order directs the U.S. Postal Service to develop new rules governing mail-in and absentee ballots and instructs the Department of Homeland Security to compile state lists identifying U.S. citizens who are at least 18 years old.<\/p>\n<p class=\"wp-block-paragraph\">Under the proposed rules, the USPS would be permitted to deliver mail-in ballots only to voters whose names appear on those state citizenship lists.<\/p>\n<div class=\"code-block code-block-3\">\n<div data-type=\"_mgwidget\" data-widget-id=\"1973003\"><\/div>\n<\/div>\n<p class=\"wp-block-paragraph\"><strong>A coalition of 23 states and the District of Columbia, led by<\/strong><\/p>\n<p class=\"wp-block-paragraph\">California, challenged the executive order in federal court in Massachusetts.<\/p>\n<p class=\"wp-block-paragraph\">The states argued that the order conflicts with constitutional provisions granting states the authority to determine voter eligibility and regulate the \u201cTimes, Places, and Manner\u201d of conducting congressional elections.<\/p>\n<p class=\"wp-block-paragraph\">U.S. District Judge Indira Talwani, an Obama appointee, agreed with those arguments and, on June 25, issued an order barring the federal government from enforcing the executive order\u2019s mail-in ballot and state citizenship list provisions for the Nov. 3, 2026, elections in the states participating in the lawsuit.<\/p>\n<p class=\"wp-block-paragraph\">On Saturday, a divided panel of the U.S. Court of Appeals for the 1st Circuit turned down the government\u2019s request to intervene.<\/p>\n<p class=\"wp-block-paragraph\">If the order were \u201cto take effect for the elections taking place\u201d in the fall, the majority wrote, \u201cit would sow confusion and threaten disenfranchisement of many eligible voters.\u201d<\/p>\n<p class=\"wp-block-paragraph\">The Trump administration asked the Supreme Court on Monday to intervene, arguing that the lawsuit is premature because the federal agencies responsible for carrying out the executive order have not yet determined how its provisions will be implemented.<\/p>\n<p class=\"wp-block-paragraph\">In the filing, Solicitor General D. John Sauer contended that the courts should not consider the states\u2019 challenge until the agencies have finalized their implementation plans.<\/p>\n<p class=\"wp-block-paragraph\">Sauer argued that even if the courts ultimately determine the states\u2019 lawsuit is properly before them, Talwani\u2019s order should be stayed because allowing it to remain in effect would cause what he described as \u201cserious irreparable harm.\u201d<\/p>\n<p class=\"wp-block-paragraph\">\u201cEven if the agencies\u2019 implementation plans end up being entirely lawful,\u201d Sauer wrote, \u201cthere is not enough time to obtain ordinary appellate relief from the injunction in order to carry them out before the November election, especially given that any such plans will need to be implemented well before November given the timing of election procedures concerning voter-roll verification and mail voting.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Jackson\u2019s order requires states to respond to the government\u2019s request by Aug. 3.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Brown Jackson Declines Trump Admin Request Over Mail-In Ballot Order President Trump\u2019s ongoing efforts to make elections more secure ahead of the fall midterms hit another snag late Monday.
